ACKNOWLEDGEMENT OF RISK AND RELEASE OF LIABILITY

I, the undersigned, hereby acknowledge and understand that certain risks of injury (including, but not limited to, serious bodily injury or death) are inherent to participating in fitness and physical therapy related activities ("Activities") at The Grid L.L.C. ("The Grid"). These types of injuries may be minor or serious and may result from my own actions, or the actions or inaction of others, or a combination or both. I understand that the Activities require a minimum level of fitness and health (physical, mental, and emotional) and that each person has a different capacity for participating in these Activities. I further acknowledge that I am the best judge of my own capacity and level of fitness and health to determine whether, and to the extent, I should participate in any Activities. I will inform The Grid of any limitations I may have and promise to provide accurate information and honest feedback regarding my participation in the Activities. I believe I am physically fit to participate in the Activities I undertake and I will immediately inform The Grid and stop participating in the Activities if I experience or would experience any discomfort or injury. I acknowledge that I am willingly and voluntarily participating in the Activities at The Grid. By signing below, I hereby agree to release, waive, indemnify, hold harmless, and not to sue The Grid or its owners, officers, directors, agents, or employees for any liability in connection with my participation in the Activities at The Grid. I further agree that this Acknowledgment of Risk and Release of Liability ("Release") shall extend to all claims that may exist, whether or not I know or suspect the existence of those claims, and I expressly waive my rights under California Civil Code Section 1542, which provides as follows: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." This Release shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws rules, and is intended to be broad and inclusive as is permitted by the laws of the State of California. If any portion of this Release is held invalid, it is further expressly agreed that the remaining provisions shall, notwithstanding, continue in full legal force and effect. This Release shall be binding on, and shall inure to the benefit of, any assigns and/or successors-in-interest to me and The Grid, its owners, officers, directors, agents and employees. BY SIGNING BELOW, I ACKNOWLEDGE THAT I AM FULLY AWARE OF AND ASSUME THE RISKS (INCLUDING, BUT NOT LIMITED TO, THE RISK OF SERIOUS BODILY INJURY OR DEATH) RELATED TO MY PARTICIPATION IN THE ACTIVITIES AT THE GRID. I AM AT LEAST 18 YEARS OLD OR I AM A LEGALLY AUTHORIZED REPRESENTATIVE PERMITTED TO SIGN THIS RELEASE ON BEHALF OF THE MINOR NAMED BELOW. I HAVE CAREFULLY READ THIS RELEASE AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND SIGN IT OF MY OWN FREE WILL.
